3. Booking & Payment
• Free Discovery Calls: Discovery calls are offered at no charge and subject to availability.
• Paid Packages: Fees for services and packages are clearly outlined in agreements or on booking pages. Payment is due as specified (e.g., upfront, milestone-based, or subscription).
• Refund Policy: Unless otherwise stated in writing, all sales are final. Refunds are not guaranteed due to the strategic and customized nature of our services.
4. Client Responsibilities
To ensure successful outcomes, clients agree to:
• Provide accurate and timely information needed for consulting work
• Actively participate in meetings, workshops, and strategy sessions
• Implement strategies or recommendations (we cannot guarantee results without execution on your part)
• Respect agreed-upon timelines for feedback, materials, and approvals
5. Intellectual Property
• All content, reports, strategies, templates, and materials provided by Katherine Way Design + Consulting remain the intellectual property of the Company unless otherwise agreed in writing.
• Clients receive a limited license to use provided materials solely for internal business purposes.
• You may not reproduce, distribute, sell, or publicly share materials without our prior written consent.
6. Confidentiality
We respect the confidentiality of all client information. Unless required by law, we will not share your proprietary or sensitive business information with third parties without your consent.
Clients also agree to keep any proprietary frameworks, tools, or processes provided by us confidential and not share them with outside parties.
7. Limitation of Liability
• Our services are designed to provide strategic guidance. While we use industry knowledge and best practices, we cannot guarantee specific results such as increased sales, revenue, or market share.
• To the fullest extent permitted by law, Katherine Way Design + Consulting shall not be liable for any indirect, incidental, consequential, or punitive damages arising out of the use of our services.
• Liability, if found, shall be limited to the amount paid by the client for the specific service rendered.

9. Termination
• Either party may terminate services with written notice, subject to the cancellation and payment terms outlined in the service agreement.
• Upon termination, the client remains responsible for payment of services already rendered or in progress.
10. Governing Law
These Terms are governed by the laws of the State of Florida, without regard to conflict of law principles. Any disputes will be subject to the jurisdiction of the state and federal courts located in Florida.
11. Changes to Terms
We may update these Terms from time to time. Any changes will be effective immediately when posted on this website. The effective date will always be updated at the top of this page.
